Lawful basis for processing your personal data

Your privacy is protected by law and this section explains howthat works. In accordance to the Data Protection Act, we are allowed to useyour personal information only if we have a proper reason to do so. Thisincludes sharing it outside RHC. The law states that we must have one or moreof these reasons:

·      Fulfil a contract we have with you, or

·       When it is our legal orregulatory duty, or

·       Where it is necessaryfor our legitimate interests (or those of a third party) and your interests andfundamental rights do not override those interests or

·       When you consent to it.

A legitimate interest is when we have a business or commercialreason to use your information. But even then, it must not unfairly go againstwhat is right and best for you.

Your Consent

PNM will process your personal data onlyafter obtaining your express consent, where it is necessary for the performanceof a contract to which you are a party or to enable you to enter into acontract or in accordance with the law. You give your consent to us through ouraccount opening mandate and during your relationship with us. We will only disclose your personal data if:

·      the law requires it or such personal data is exempted from dataprotection laws;

·       such disclosure is forthe administration of justice or in the public interest or relates to the useof a unique identification number to facilitate sharing information and avoidmultiple registrations among public sector agencies;

·       such disclosure isnecessary for the performance of a contract to which you are a party or toenable you to enter into a contract; or

·       you agreed that we maydisclose your data for the purposes for which such data has been collected andof which you have been informed.

Change of Purpose

We will only use your personal data for the purposes for whichwe collected it, unless we reasonably consider that we need to use it foranother reason and that reason is compatible with the original purpose.

What type of information PNM may collect from you?

National Identifier:  A number given to you by a governmentto identify who you are, such as a National Identity Card, Passport.

Contact details:  Where you live and how to contact you

Socio-Demographic:  This includes details about your workor profession, nationality, education and where you fit into general social(Social Research/Survey) or income groupings.

Financial:  Your financial position, status andhistory

Contractual/ Transactional:  Details about payments to andfrom your accounts with us, and insurance claims you make.

Locational:  Location data from your mobile phoneand the IP address of your connection when using a computer while using our /my PNM Mobile application or our Online Portal. Data pertainingto the shops where you make a purchase with your PNMCard –Rewards.

Transactional:  Details about payments to and fromyour accounts with us and insurance claims you make.

Behavioural:  Details about how you use ourproducts and services.

Usage Data:  Other data about how you use ourproducts and services.

Technical:  Details on the devices and technologyyou use.

Communications: What we learn about you from letters,emails and conversations between us.

Social relationships:  Your family, friends and otherrelationships.

Open Data and Public Records:  Detailsabout you that are in public records such as the Electoral Register andinformation about you that is openly available on the internet.

Documentary Data:  Details about you that are stored indocuments in different formats or copies of them. This could include thingslike your passport, driver ’s license or birth certificate.

Special categories of personal data: The law and otherregulations treat some types of personal information as special. We will onlycollect and use these types of data if the law allows us to do so:

We do not rent, sell or otherwise disclose personal informationabout our clients with unaffiliated third parties for their own marketing use.

We may disclose your information to service providers we haveretained to perform services on our behalf. These service providers arecontractually restricted from using or disclosing the information except asnecessary to perform services on our behalf or to comply with legalrequirements.

Notwithstanding the above, consent is not necessary in the caseof Reinsurance.

Does PNM have security measures in place toprotect your information?

PNM has implemented reasonable physical,technical and administrative security standards to protect personal informationfrom loss, misuse, alteration or destruction.

Our service providers and agents are contractually bound tomaintain the confidentiality of personal information and may not use theinformation for any unauthorized purpose.

Does PNM collect information from children?

Children have the same rights as adults over their personaldata. They can exercise their own rights as long as they are competent to doso. Where a child is not considered to be competent, an adult with parentalresponsibility may exercise the child ’s data protection rights on theirbehalf. For children under 16, we need to get consent from whoever holdsparental responsibility for them.

Our websites are not directed to children and we do notknowingly collect personal information from children on our websites.
